By downloading, accessing, or using the TryFirst mobile application ("App") or website (together, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.
TryFirst lets you create a personal body scan and use it to generate a virtual preview of how clothing items from participating online retailers may look and fit on you before you purchase. TryFirst does not sell clothing directly — purchases are completed on the retailer's own site or app.
You must be at least 16 years old to create a body scan and use TryFirst. If you are under the age of majority in your jurisdiction, you may only use the Service with the consent and supervision of a parent or legal guardian.
You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized use.
Creating a virtual try-on requires camera access and the creation of a body scan. Details on how this data is collected, used, and stored are set out in our Privacy Policy, which forms part of these Terms.
You agree not to misuse the Service, including by: attempting to reverse-engineer the App; uploading images of anyone other than yourself without consent; scraping or automating access to the Service; or using the Service for any unlawful purpose.
Product availability, pricing, sizing information, and order fulfillment are controlled by the third-party retailers featured in the App. TryFirst is not a party to any purchase you make and is not responsible for retailer errors, shipping, returns, or customer service.
The Service, including its design, logos, and underlying technology, is owned by TryFirst and protected by intellectual property laws. You retain ownership of your body scan and any images you upload.
Virtual try-on renders are an approximation intended to assist your purchase decision and are provided "as is." Actual fit, drape, and color may vary from the render due to fabric behavior, lighting, manufacturing variance, and other factors.
To the maximum extent permitted by law, TryFirst is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including purchase decisions made based on a virtual try-on render.
We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service and request deletion of your account and body scan data at any time.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
